8. Availability of products
All orders are subject to the availability of the products. If difficulties occur in relation to the supply of products or if there are no items left in stock, we will reimburse you any amounts paid.
9. Shipments and delivery
Urbidermis will offer you as many shipping options as possible under the agreements reached between Urbidermis and various logistics services suppliers.
For shipments within the Spanish territory, the normal delivery period varies from 3 to 5 working days for products in stock.
Urbidermis will chose the most appropriate company to make the shipment according to the type and geographic region. Shipments are delivered directly to the shipping address you have provided us with. Someone must be present at the delivery address during working hours and a telephone number is required (within a margin of 4-5 hours to be able to coordinate the delivery).
The shipping cost will be calculated by the system during the purchase process and will depend on the destination.
If it is not possible to deliver a product within the periods indicated during the purchase process for reasons of availability, Urbidermis will contact the customer via email within a maximum period of 48 working hours. The customer may opt to cancel their order without the possibility of being subject to any additional charge.
If a significant price change occurs in relation to the delivery cost, Urbidermis will inform you of the change via email and you will be able to opt to cancel your order without the possibility of being subject to any additional charge.
When placing an order, you declare that you understand and accept that the shipping price, delivery periods, service quality and the delivery point are subject to the various modes of transport from those available for different shipping areas and the availability of the product chosen. Urbidermis does not deliver on bank holidays, Saturdays or Sundays.
Additionally, the delivery periods may be affected by extraordinary incidents affecting the logistics service company(ies), due to difficulties in the delivery of the goods and/or due to force majeure; in any case, no delay in delivery with respect to the periods indicated shall grant the user the right to claim any compensation whatsoever.
If we are unable to comply with the delivery date for whatever reason, we will inform you of this circumstance and give you the option of continuing with the purchase establishing a new delivery date or cancelling the order with a full refund of the price paid. For the purposes of this Legal Notice, “delivery” shall be understood to have taken place or it shall be understood that the order has been “delivered” when you, or a third party designated by you, take material possession of the products, which will be evidenced through a signature on receipt of the order at the agreed delivery address.
If we are unable to deliver your order, it will be returned to our warehouse. We will also send you an email to agree upon another delivery date. If a second date is agreed upon and you are once again not at the delivery address, we ask that you please contact us to make arrangements for delivery or arrange to pick up the product.
If 30 days elapse from when your order is available for delivery without the order having been delivered for reasons not attributable to us, we will understand that you wish to withdraw from the contract and will consider this terminated. As a result of the termination of the contract, we will return all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a different delivery method from the ordinary, most economic option we offer) without undue delay and in any case within a maximum period of 14 days from the date on which we consider the contract terminated. Please bear in mind that the transport resulting from said termination may have an additional cost, for which reason we will be authorised to pass the corresponding costs on to you.
10. Returns
These shall be governed by that set out in Royal Legislative Degree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.
You will have a period of 14 working days from receipt of the order to return this. You must notify Urbidermis of your wish to exercise the right of withdrawal within the stipulated period and through any means admitted by law.
Any item purchased on Urbidermis’ website can be returned. Bear in mind that no refund will be made if the product has been used beyond merely being opened, if products are not in the same condition as on delivery or when these have been damaged in any way, so please be careful with the product(s) while they are in your possession.
The return costs shall be borne by the customer. In these cases, Urbidermis will return the cost of the purchase through the same payment method used for the purchase. Urbidermis will not return the amount or resend any goods until it has verified the receipt and condition of the packaging and accessories of the item returned.
Conditions regulating product returns:
1) Product faulty on receipt: Urbidermis will exchange this for the same item or reference once the faulty product has been returned. In this case, you will only be charged for the initial delivery, and Urbidermis will bear the costs of returning the item and sending out the new one. If you wish to exchange your product for another item or reference you will bear the cost of the return and shipping of the new product. In the event of the deterioration of the product or lack of conformity due to the transport process, you must notify Urbidermis of this via email to info@urbidermis.com within a period of 48 hours from receipt of the shipment.
2) Incorrect product: Urbidermis will bear the costs of collecting the incorrect product and sending out the one corresponding to your order.
11. Guarantees
If you enter a contract as a consumer and user, you will be subject to that set out in Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Users Law and the applicable legislation for each type of product.
When an incident occurs that justifies the use of the guarantee, a repair, replacement, reduction or refund will be made, according to the legally established terms.
Products are understood to be compliant with the contract provided they (i) match the description made by us and possess the qualities we have presented on the Platform, (ii) are suitable for the normal uses of products of the same type and (iii) offer the normal quality and performance that can reasonably be expected of a product of the same type.
In this respect, if any product does not comply with the contract, please inform us of this immediately and at the latest, within a period of 48 hours from when you opened the package, providing the details of the product and the damage suffered.
The amounts paid for products returned as a result of damage or a defect, when this is verified to exist, will be refunded to you in full, including the delivery costs paid to deliver the product to you and any costs you may have incurred in returning the product to us. The refund shall take place using the same payment method as that used to pay for the purchase. In any case, your rights recognised by current legislation are not affected.
